Dave Jochnowitz is an associate in the Washington, DC office, where he represents whistleblowers. Prior to joining Tycko & Zavareei LLP in 2021, Dave clerked for Magistrate Judge Peggy Kuo of the United States District Court for the Eastern District of New York. Before that, he worked at a law firm that exclusively represented whistleblowers under the federal and state False Claims Acts and the whistleblower programs of the SEC, CFTC, and IRS. His practice spanned diverse industries, with clients including physicians, nurses, billing specialists, sales reps, defense contractors, investment analysts, securities and commodities traders, and C-suite executives.
He has worked on whistleblower matters at every level of the federal courts, representing clients before trial and appellate courts and acting as part of a Supreme Court amicus team. At Tycko & Zavareei, he maintains an active trial and appellate docket, representing clients alleging healthcare fraud, government contracting fraud, and fraudulent securities offerings.
Dave graduated from Harvard Law School in 2013. While in law school, he was a member of the University’s Greenhouse Gas Reduction Committee and the recruitment and training director for Project No One Leaves, which worked with tenants and homeowners affected by foreclosure. Prior to law school, he was a Peace Corps volunteer in Malawi, and he continues to serve on the boards of two non-profits dedicated to improving lives in and building cultural connections with Malawi. He graduated magna cum laude from Brooklyn College in 2007 with a Bachelor of Arts in economics.
Represented a physician whistleblower in a case in which the government intervened against a lab company and its executives and obtained a $114 million jury verdict, upheld on appeal. The whistleblower’s complaint alleged a fraudulent kickback scheme for expensive and unnecessary tests.
$50 million settlement following a former hospital employee’s whistleblower’s case alleging Stark Law and Anti-Kickback Statute violations by a regional hospital.
Represented a physician client in a multi-whistleblower case against various lab companies alleging violations of the Anti-Kickback Statute, resulting in settlements of $48.5 million and $1.5 million in cases in which the government intervened and $6 million in a case pursued by the whistleblower without government intervention.
$22.8 million settlement in a case brought by a former purchasing and logistics employee of a multi-national corporation alleging that the company evaded U.S. customs duties owed on imported materials for chemical and natural gas plants.
Successfully represented an anonymous overseas client who contested a preliminary award of 10%, the minimum amount allowed under the SEC whistleblower program, resulting in a higher award.
Represented whistleblowers in the financial services industry and other victims of fraud who provided information to the SEC and other federal authorities relating to ongoing Ponzi schemes, leading to civil and criminal enforcement actions against the perpetrators.
