CVS False Billing to Federal Healthcare Programs

Date Published
Oct 22, 2026

CVS Pharmacy Inc., CVS Health Corporation, and related corporate entities have agreed to pay $315 million to resolve False Claims Act allegations that the pharmacy chain systematically filled opioid and other controlled-substance prescriptions that lacked a legitimate medical purpose, then submitted those claims for reimbursement to Medicare and other federal healthcare programs. The conduct alleged spans more than a decade, from October 17, 2013 through December 2, 2025. The settlement was announced jointly by the U.S. Department of Justice Civil Division, the DEA, HHS-OIG, and the U.S. Attorney’s Offices for the Districts of Rhode Island and Hawaii.

The case was initiated by Hillary Estright, a former CVS employee whose firsthand observations of the company’s dispensing practices formed the basis of the qui tam complaint. Estright alleged that CVS pharmacies were filling prescriptions for controlled substances, including opioids, that did not satisfy the legal requirement of a legitimate medical purpose, a cornerstone of the Controlled Substances Act and a prerequisite for any valid prescription billing to a federal payer.

Estright’s share of the $315 million recovery has not yet been determined. Under the False Claims Act, relators in cases where the government intervenes are typically entitled to between 15 and 25 percent of the proceeds, meaning her award could reach into the tens of millions of dollars once finalized. The scale of the settlement, and the breadth of the alleged conduct across what appears to be CVS’s national pharmacy network over more than a decade, makes this one of the more significant controlled-substance enforcement actions brought against a major retail pharmacy chain.
