On May 26, 2011, the U.S. Department of Justice announced that Fresenius Medical Care Holdings, Inc., the world’s largest provider of kidney dialysis, had been ordered to pay $82.6 million by the U.S. District Court in Nashville for fraudulently billing Medicare for home dialysis supplies and equipment from 1999 to 2005. According to the lawsuit, Fresenius submitted claims for payment for home dialysis patients that were prohibited by Medicare in violation of the False Claims Act. The qui tam lawsuit was brought on behalf of the Government by two whistleblowers.
